Where the Family Affairs Judge sits
In certain critical situations, acting swiftly before the Family Affairs Judge (JAF) is indispensable. Two legal avenues allow you to obtain a hearing within a very short timeframe:
- The protection order (ordonnance de protection),
- The expedited petition (saisine à bref délai),
which enables you to obtain a hearing in approximately three weeks.
The Expedited Petition (Bref Délai): An Exceptional Procedure
Obtaining a hearing before the Family Judge within three weeks is exceptional, especially when considering that standard processing times often exceed six months.
However, to qualify for this expedited procedure, you must demonstrate genuine, substantiated urgency.
What Constitutes an Emergency in the Eyes of the Court?
Family judges are exceptionally strict in their evaluation of urgency, given the severe backlog across judicial chambers. Only specific critical situations can justify accelerated handling:
- Intra-family violence (even if a formal protection order is not sought),
- Severe illness of a parent or child,
- Sudden, disruptive changes of circumstance directly impacting the children (child abduction, abrupt school withdrawal, etc.).
Conversely, financial hardship, even when acutely severe, is never deemed an emergency, barring extremely rare exceptions.
One of the Most Difficult Petitions to Obtain
It must be stated clearly: approximately 75% of requests for expedited hearings (bref délai) are rejected.
This is one of the most delicate procedures to initiate because the judge reads the petition very rapidly; it must therefore be impactful and concise, and must never bury key arguments beneath an avalanche of secondary or poorly structured grievances.
A Rigorous Strategy, Solid Evidence

- Focus on the core decisive arguments,
- Support the petition with concrete and compelling evidence: medical certificates, sworn declarations, chronological logs, etc.,
